Rally Gift — Terms of Service

These Terms of Service (“Terms”) govern your use of RallyGift, operated by Gormly LLC, a Missouri limited liability company (“RallyGift,” “we,” “us,” or “our”).

By accessing or using RallyGift.com (the “Platform”), you agree to these Terms.

1. What RallyGift Is

RallyGift is a platform that enables individuals (“Organizers”) to create group gifting campaigns (“Rallies”) and collect voluntary contributions from others (“Contributors”).

RallyGift:

  • Is not a bank.

  • Is not a trustee or escrow agent.

  • Does not guarantee the purchase or delivery of any gift.

  • Does not control how Organizers use collected funds.

Organizers are solely responsible for how funds are used.

2. Payments & Stripe

All payments are processed securely through Stripe.

By contributing or receiving payouts, you agree to:

  • Stripe’s Terms of Service

  • Stripe’s Privacy Policy

RallyGift uses Stripe Connect Express to facilitate payouts.

Organizers may be required to provide identity and banking information directly to Stripe in order to receive funds. RallyGift does not collect or store bank account information.

3. Platform Fees

RallyGift may charge a platform fee (currently 6.5%).

  • Contributors may optionally choose to cover the platform fee.

  • If the contributor does not cover the fee, the fee may be deducted from the total raised.

  • Platform fees are non-refundable except at RallyGift’s discretion.

RallyGift reserves the right to modify fees at any time with notice.

4. Payouts

Payouts are subject to:

  • Rally deadline expiration

  • Completion of Stripe onboarding

  • Compliance with Stripe requirements

  • Fraud review if applicable

Payout timing depends on Stripe and banking systems. RallyGift does not guarantee deposit timing.

Once a payout is initiated, it cannot be reversed by RallyGift.

5. Refunds

Refunds are not guaranteed.

RallyGift may, at its discretion, issue refunds in limited circumstances. Stripe processing fees (currently approximately 3.5%) may be deducted from refunded amounts.

Chargebacks or payment disputes may result in:

  • Suspension of a Rally

  • Withholding of payout

  • Recovery of funds from an Organizer

6. Organizer Responsibilities

Organizers agree to:

  • Use funds for lawful purposes

  • Not misrepresent the purpose of a Rally

  • Not engage in fraud or deceptive conduct

  • Comply with all applicable laws

RallyGift may suspend or terminate access for violations.

7. Prohibited Use

You may not use RallyGift to:

  • Facilitate illegal activity

  • Raise funds for prohibited or high-risk activities

  • Launder money

  • Circumvent financial regulations

  • Infringe intellectual property rights

We reserve the right to remove any Rally at our discretion.

8. Taxes

Organizers are solely responsible for any taxes associated with funds received.

Stripe may issue tax forms (e.g., 1099-K) depending on volume and jurisdiction.

RallyGift does not provide tax advice.

9. Limitation of Liability

To the maximum extent permitted by law:

RallyGift shall not be liable for:

  • Misuse of funds by Organizers

  • Disputes between Organizers and Contributors

  • Payment processing delays

  • Chargebacks initiated by Contributors

  • Indirect or consequential damages

Use of the Platform is at your own risk.

10. Indemnification

You agree to indemnify and hold harmless Gormly LLC and RallyGift from claims arising from:

  • Your use of the Platform

  • Violation of these Terms

  • Fraudulent or unlawful conduct

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict of law principles.
